The present terms and conditions are valid as of September 20, 2009. This edition cancels and replaces all previous versions.
ARTICLE 1. DEFINITIONS - TOURIST PACKAGE - SCOPE OF APPLICATION
1.1 Definitions
The definitions below have the same meaning whether used in the singular or plural.
" Des Hôtels & Des Îles " refers to LEADER, the service provider.
"Partner" refers to all suppliers of Services.
"Service" refers to any service offered on the site, such as the provision of airline tickets, accommodation, car rental, tourist packages or any other services offered on the www.deshotelsetdesiles.com site .
"Site" refers to the www.deshotelsetdesiles.com website.
"User" refers to any user of the Site who browses, acquaints themselves with, books and/or purchases one or more Services offered on the Site.
1.2 Tourist package
For the purposes of these General Terms and Conditions, a tourist package is defined as a booking, offered for a global price, of a service exceeding 24 hours or including an overnight stay, and combining at least two of the following three elements:
- Transportation or car rental services,
- Accommodation,
- A tourist service not ancillary to transport or accommodation, but representing a significant proportion of the overall price.
The booking of tourist packages is governed by Title1 of Book II of the French Tourism Code, relating to the organization of travel and holiday sales.
In accordance with article R. 211-14 of the French Tourism Code, articles R. 211-5 to R. 211-13 of the said Code are reproduced hereafter in fine of the present General Sales Conditions.
These provisions are supplemented by the specific conditions of the booking as made on the www.deshotelsetdesiles.com website .
1.3 Scope of application
These general conditions of use (hereinafter the "General Conditions") govern the offer and provision of the Services.
Services may only be booked by Users who have read and understood these General Terms and Conditions in their entirety and accepted them by ticking the appropriate box or clicking on the appropriate hyperlink. Without this acceptance, it is technically impossible to continue the booking process.
Consequently, completion of the reservation process on the Site implies express acceptance by the User of these General Conditions.
The specific terms and conditions of the Partners (hereinafter referred to as the "Specific Terms and Conditions") also apply to the offer and supply of Services, in accordance with the same terms and conditions as the General Terms and Conditions. Acceptance of the Specific Conditions by the User occurs at the time of actual booking.
The General Terms and Conditions may be modified at any time, without prior notice, it being understood that such modifications will be inapplicable to reservations of Services made previously. It is therefore imperative that the User consults and accepts the General Terms and Conditions at the time of booking, in order to be sure of the provisions in force.
ARTICLE 2. RESERVATION
2.1 Capacity - Use of the site
The purpose of the Site is to assist the User in searching for travel and tourism-related Services, and to make appropriate reservations, as well as to conclude any related transactions with Partners. The User must be at least 18 years of age, legally capable of contracting and using this Site in accordance with the General Terms and Conditions. The User guarantees the truthfulness and accuracy of the information provided by him/her on the Des Hôtels & Des Îles website.
Except in cases of fraud for which it is up to the User to provide proof, the User is financially responsible for his or her actions on the Site, and in particular for the use made of his or her User name and password. The User also guarantees the truthfulness and accuracy of the information provided on the Site.
Fraudulent use of the Site, or use that contravenes these General Terms and Conditions, may result in the User being denied access at any time to the Services offered by deshotelsetdesiles.com and/or its Partners, or to other features of the Site.
Warning: Reminder of the terms of article L 313-1 of the French Penal Code: "Fraud is the act, either by the use of a false name or a false capacity, or by the abuse of a true capacity, or by the use of fraudulent maneuvers, of deceiving a natural person or legal entity and thus determining, to his detriment or to the detriment of a third party, to hand over funds, securities or any property whatsoever, to provide a service or to consent to an act giving rise to an obligation or discharge. Fraud is punishable by five years' imprisonment and a fine of €375,000".
2.2 Booking and cancellation
You can book the Services you require on the Des Hôtels & Des Iles website (hereinafter the "Site"), which can be accessed at www.deshotelsetdesiles.com. This order is governed by the present general terms and conditions of sale detailing the content of your order.
Please note that products or prices available on a first visit to the site may no longer be available on a subsequent visit, even if you have saved your request.
Confirmation of the reservation, which includes the essential elements, such as the identification of the Service(s) reserved and the price, will be sent to the User by e-mail only.
If you do not receive a confirmation e-mail from Des Hôtels & Des Îles, your reservation will either not be taken into account or will be considered as SPAM. It is therefore your responsibility to ensure that you have received the confirmation e-mail. If not, please contact us by e-mail: info@deshotelsetdesiles or by telephone 01 42 56 46 98.
2.3 Modification
Any request to modify your order must be made by e-mail to info@deshotelsetdesiles.com or by telephone to DES HOTELS & DES ILES on the following telephone number 01 42 56 46 98 (price of a local call), which will have been communicated to the client on the e-mail confirming his order. DES HOTELS & DES ILES will forward the request for modification and the amount of the related costs by e-mail for acceptance.
Once you have accepted the modification and paid the corresponding fees, you will receive confirmation of the modification by e-mail. In the absence of a confirmation e-mail from DES HOTELS & DES ILES, the modification has not been taken into account. It is therefore your responsibility to ensure that you have received the confirmation e-mail.
2.4 Convocation and collection of travel documents
Travel documents issued in respect of a Service ordered via the Site are sent by electronic mail (email) to the address given by the User at the time of booking, in accordance with the provisions set out for each type of Service accessible on the Site prior to booking or in the Specific Conditions.
Should the delivery of travel documents be rendered impossible due to an error in the User's contact details, neither the Partner(s) concerned nor www.deshôtelsetdesiles.com may be held responsible.
2.5 Proof
It is expressly agreed that, except in the event of an obvious error on the part of the Partners or Des Hôtels & Des Îles for which the User can provide proof, the data stored in the information system of Des Hôtels & Des Îles and/or its Partners have evidential value with regard to reservations made by the User. Computer or electronic data constitute valid proof and as such are admissible under the same conditions and with the same evidential value as any document drawn up, received or kept in writing.
2.6 Right of withdrawal
The User is hereby informed that, in application of article L. 121-20-4 of the French Consumer Code, the Services offered on the Site by Des Hôtels & Des Îles on its own behalf or on behalf of its Partners are not subject to the right of withdrawal provided for in articles L. 121-20 et seq. of the French Consumer Code concerning distance selling.
Consequently, Services booked on the Site are subject exclusively to the cancellation and modification conditions set out herein and/or in the applicable Partner Specific Conditions.
ARTICLE 3. DETAILS OF SERVICES
Des Hôtels & Des Îles offer travel Services on the site, in particular tourist packages, airline tickets, accommodation reservations, car rental and travel insurance. The Special Offers Des Hôtels & Des Îles are all the said Services provided directly to Users by Des Hôtels & Des Îles. For all other Services, Des Hôtels & Des Îles acts in the name and on behalf of various Partners (hotel and/or transport service providers, tour operators and travel agents).
The following indicative list is not exhaustive and does not replace the Specific Conditions as they appear in the reservation.
3.1 Air transport services
Air transport services are offered as part of a tourist package.
3.1.1 Travel conditions
Air transport conditions are governed by the specific conditions of the airlines or Partners.
The responsibility of Des Hôtels & Des Îles does not replace that of French or foreign carriers providing transport or transfer of passengers and luggage. Under no circumstances can Des Hôtels & Des Îles be held responsible for circumstances beyond its control, for the actions of third parties not involved in the provision of the planned services, or for poor execution due to circumstances attributable to the User.
It is the User's responsibility to respect the instructions of airlines and Partners, particularly with regard to check-in times. The User's attention is drawn to the need to allow sufficient time for possible delays when ordering a trip on the Site that includes a connection or transit, particularly when this includes a change of airport. It is advisable to check in at least four hours before departure time for international flights, and at least two and a half hours in advance for domestic flights.
The consequences of accidents or incidents that may occur during air transport are governed by the provisions of the Montreal Convention of May 28, 1999 or the Warsaw Convention of October 12, 1929, as amended, or by local regulations governing transport, according to the law of the country concerned.
The name of the airport, when the city served by the contract includes more than one, is given for information only and may be subject to change.
Customers who have booked flights at special rates (family, honeymooners, young people, babies, couples, senior citizens, etc.) must provide proof of their status, which may be requested at check-in. Children under 2 years of age do not have a seat on the aircraft unless their parents request a full seat specifically for them. The User's attention is drawn to the fact that this provision is only valid if the children are under 2 years of age for the entire duration of the trip, on both the departure and return dates. Indeed, airlines consider that children over the age of 2 on the date of return must purchase a round-trip ticket at the child fare. Costs incurred by failure to comply with this rule will not be reimbursed.
Since 15/01/2017, minors unaccompanied by their legal representative once again need an authorization to leave the country (AST). The AST has a specific format (Cerfa form n°15646*01 available at www.service-public.fr). Only the signature of a person with parental authority is required. The AST may not exceed one year. This AST does not remove the need for the minor to carry (in addition to the signed AST and a copy of the AST signatory's identity document) his/her CNI or passport, or a visa, depending on the destination country. We strongly advise you to find out in advance what documents are required by the destination country, by consulting the country files on the www.diplomatie.gouv.fr website .
Similarly, if the child is traveling with just one parent, some countries may require proof that the other parent has authorized the trip. For all destinations requiring a passport, minors of any age must now have their own passport. A child registered on an adult's passport may only travel with the adult who holds the passport on which he or she is registered. The family record book is not an identity document, even for domestic flights. It is imperative (wife, child) that the name on the passport or identity document is identical to the name under which the order was placed and the travel and residence documents issued.
3.1.2 Formalities
The formalities mentioned on the Site are intended for nationals of France, Belgium, Luxembourg and Switzerland.
In all cases, the completion of formalities remains the responsibility of the User.
For non-French nationals, it is the User's responsibility to check with the relevant authorities (Consulate, Embassy, etc.), taking into account their nationality, the various police, customs and health formalities for their trip, including stopovers and transits, and to comply with them.

Certain changes may occur between the publication of information on the Site and the User's departure date. We therefore advise the User to consult the Site just before departure.
The User is informed on the Site of the administrative and/or health formalities required for the execution of the trip. It is the User's responsibility to be aware of these. The User is responsible for fulfilling and paying for the police, customs and health formalities required for your trip, such as passport, national identity card, residence permit, parental authorization, visa, medical certificate and vaccination booklet.
Should the User and/or the persons registered by him/her be denied boarding or access to the destination country due to failure to comply with police, health or customs formalities, the User alone will bear any penalties and/or fines that may be imposed as a result of failure to comply with police, health or customs regulations, as well as any consequences that may result therefrom.
Please note that in some countries, passports must be valid for at least 6 months from the date of return. Children aged 15 and over must have identity papers in their name.
Should the User be unable to depart on the date indicated due to non-compliance with these administrative and health formalities, the price paid will not be reimbursed under any circumstances.
In the event of loss or theft of a ticket, the User must make a specific declaration to the police and the airline company and purchase another ticket from the issuing Partner. Only the Specific Conditions of the Partner concerned may provide for reimbursement.
3.1.3 Air carrier liability
Please note that the liability of air carriers is generally limited by the national or international law applicable to them, or by their own Specific Conditions. In the case of air transport, an extract of these conditions is given to the User with his/her ticket.
3.1.4 Electronic ticket
The electronic ticket is a non-materialized ticket. When booking an e-ticket, the User must go to the airline's check-in counter with valid travel documents (passport, visa, identity card, etc.) in order to obtain a boarding pass. The User must therefore respect the time limits set for check-in.
3.1.5 Personal effects baggage
Des Hôtels & Des Îles cannot be held responsible for loss, theft or damage to luggage or personal effects during the trip. In the event of a problem, users are advised to file a complaint with the relevant local authorities.
In the case of air transport, airline liability is limited or excluded in the event of loss, damage or delay of baggage, in accordance with the above-mentioned Warsaw and Montreal conventions; these conventions may also benefit the Agency in the event of its liability being invoked.
Any claim must be made immediately at the airport by the customer to the carrier's or the airport's services, as soon as the damage has been ascertained. Luggage insurance is not included in the prices of services offered on the Site. However, insurance may be offered by one of our insurance providers.
IMPORTANT: if you are taking medication, keep it with you in your hand luggage (with prescriptions) and do not leave it in the hold. We also recommend that you keep your valuables with you in your hand baggage: cameras, camcorders, eyeglasses, apartment keys, car keys, jewelry, etc. if they are allowed in the cabin and within the weight limit authorized by the carrier. In addition to the items already prohibited, passengers must comply with the new restrictions on liquids contained in cabin baggage introduced on November 6, 2006; at security checks, passengers must separately present a closed transparent plastic bag measuring approximately 20cm by 20cm (bottles and tubes of up to 100ml each).
3.1.6 Cancellation and modification fees
Cancellation or modification of your reservation will incur costs. The user will be reimbursed in accordance with the general terms and conditions of sale of the airline on which he/she has planned to travel.
3.2 Accommodation services
These services are offered either as accommodation only, or as part of a tourist package.
3.2.1 Travel time
The day of departure and the day of return are included in the length of stay. The first and/or last night may be shortened by a late arrival, an early departure or an overnight flight.
3.2.2 Room ownership
Please note that rooms are usually only available from 3pm and must be vacated by 12pm, regardless of the time of arrival or departure of the means of transport used.
Single rooms generally comprise a single bed or two single beds. These rooms are often subject to a supplement. Double rooms are available with either two beds or one double bed.
3.2.3 Classification
The indication of the level of comfort attributed to the hotels appearing in the description consultable on the Site corresponds to a classification established with reference to the local standards of the host country, and which may therefore differ from French standards; it is provided for information purposes only. In exceptional cases, the hotel initially booked may be replaced by another hotel of the same category offering equivalent services.
3.2.4 Activities
It may also happen that certain activities proposed by the Partners and indicated in the description on the Site, are cancelled, notably for climatic reasons, in the event of force majeure, a stay outside the tourist season, or when the number of participants required to carry out the activity is not reached.
Cancellation of any activity for reasons of force majeure shall not in any event result in any compensation to the User.
The order in which the sites are visited is given for information only, and may be modified by the Partners.
3.2.5 Meals
When meals are included in the tourist package, their number depends on the number of nights. Full board includes breakfast, lunch and dinner. Half-board includes breakfast and either lunch or dinner, depending on the package. Full and half board start with the meal preceding the first night and end with breakfast following the last night of accommodation.
Please note that, unless otherwise stated in the description of the tourist packages on the Site, drinks are not included in meals and are the responsibility of the User. In the absence of drinking water, the purchase of bottled water is the sole responsibility of the User.
Parents are invited to bring along baby food, which may not always be available on site.
3.3 Vehicle rental services
The provision of vehicle rental services is governed by the specific terms and conditions of the Partners.
3.3.1 Payment terms
When taking possession of the vehicle, the main driver must present his/her bank card and identity papers.
In addition, a pre-authorization request corresponding to the security deposit is made by the Partner to the User's bank. The User must therefore contact his bank to find out his spending limit, to which this pre-authorization will be applied.
If the User fails to comply with the above rules, the Partner will not release the vehicle to the User.
The User must check the Partner's Specific Terms and Conditions to see which bank cards are accepted by the Partner, as some cards such as Electron cards are not accepted.
3.3.2 Additional charges
For vehicle rentals in certain countries, some partners automatically charge for a full tank of petrol when the vehicle is returned, if this has not already been done by the user before returning the vehicle.
The User is obliged to return the vehicle to the same agency where it was picked up, failing which the Partners will charge an additional fee known as the "Abandonment Fee".
3.4 On-site activities
The booking of "On-site activities" alone is governed by the Specific Conditions of the Partners.
These services are non-transferable, non-changeable and non-refundable.
3.4.1 Prices
The descriptions of the Services presented on the Site specify which of the "On-site Activities" are included in the price mentioned. Prices are indicated in Euros and are generally understood to include all taxes, unless otherwise stated on the site.
ARTICLE 4. PRICES
The descriptions of the trips presented on the Site specify, for each trip, the services included in the price.
Prices are quoted in Euros and include all taxes, unless otherwise stated on the Site.
It is reminded that certain additional taxes (tourist tax, tourist tax or visa) may be imposed by the local authorities of certain countries and must be paid locally. Where such additional taxes exist, they are payable by the User.
Tourist package prices are calculated according to the number of nights, not the number of full days.
In general, and unless expressly stated otherwise, prices do not include insurance, airport services, excess baggage charges, transfers from the airport to the place of accommodation, visa and vaccination fees, and all personal expenses (laundry, telephone, drinks, room service, tips, etc.), as well as excursions and the use of sports facilities, and more generally any service not expressly mentioned on the Site.
ARTICLE 5. MEANS OF PAYMENT
5.1. Payment in 1 instalment
The user will pay the full price of the service online by credit card in order to complete the booking. In certain cases, the user will have the option of paying in 2 or 4 instalments.
5.2. Payment in 2 instalments
In order to confirm the package tour, the user must pay an online deposit of 300 euros (three hundred euros) per person by credit card. The balance must be paid either 5 days before departure, by bank transfer, or by telephone by credit card to the booking agents.
5.3 Payment in 4 instalments
In certain cases, the user may pay in 4 instalments under the conditions specified below. This method of payment can only be used to pay for Flight + Hotel packages. Hotels alone are excluded from this payment method.
If the file is eligible for this method of payment and the customer has opted for payment in several instalments, payment will be subject to the financing organization's general terms and conditions of sale, available below:
5.3.1 "4 X payment" payment methods
To validate and pay for their order, customers have several means of payment:
Payment in 4X by credit card with our partner FLOA.
Our financial partner FLOA offers payment solutions for your purchases of goods and/or services, in 4 instalments by credit card. These payment solutions are reserved for individuals (natural persons of legal age) residing in France, holding a Visa or MasterCard bank card with a validity date corresponding to the duration of the refund. FLOA, RCS Bordeaux 434 130 423, headquartered at Immeuble G7 - 71 Rue Lucien Faure, Bordeaux (33300), is subject to supervision by the Autorité de Contrôle Prudentiel et de Résolution (ACPR), 4 Place de Budapest, CS 92459, 75436 PARIS CEDEX 09, and is registered with ORIAS under number 07 028 160 (www.orias.fr).

5.3.2 Borrower conditions
The present contract is reserved for private individuals (natural persons of legal age) residing for tax purposes in Metropolitan France, for the payment of their order on the merchant site. The validity period of the card used must be later than the date of the last "4 X payment" due date.
Systematic authorization cards such as Electron or Maestro, e-cards, Indigo and American Express are not accepted.
ARTICLE 6. PHOTOS AND ILLUSTRATIONS
Every effort is made to provide photos and illustrations that give the User an overview of the Services offered. The purpose of these photos and illustrations is to indicate to the User the category of accommodation or the degree of comfort.
ARTICLE 7. INSURANCE
No insurance is included in the prices offered on the Site. The User is therefore advised to take out an insurance policy covering the consequences of certain cases of cancellation, and an assistance policy covering certain specific risks, in particular repatriation costs in the event of accident or illness.
Des Hôtels & Des Îles informs the customer of the specific cancellation, assistance and repatriation insurance conditions prior to confirmation of the travel booking, by means of a link to the said conditions which the user may print out. At the time of booking, the customer can take out a specific insurance contract with several options: Multirisk or Cancellation or Assistance. Alternatively, the user may choose not to take out any additional insurance.
To this end, Users are offered various types of insurance policy, underwritten by ASSUREVER - 4, Place de Budapest- 75436 Paris Cedex 9 under policies N°5841 and N°14073.
The risks covered by these policies, as well as their cost and the amount of cover, are indicated on the Site for information purposes only. If an insurance contract is taken out, the insurance policy will be given to the User.
Claims must be made directly to the insurance company, in accordance with the terms of the insurance contract.
ARTICLE 8. INSURANCE - FINANCIAL GUARANTEE

Des Hotels & Des Iles has taken out a policy with Allianz Assurance, no. 0810008209, covering its Professional Civil Liability.
Des Hôtels & Des Îles is a member of the national trade union "Les Entreprises du Voyage".
SECTION 9. USER SERVICE AND COMPLAINTS
9.1 User service
The User may contact Des Hôtels & Des Îles during the booking process for assistance, information and clarification regarding the purpose and conditions of the booking:

The personal data communicated by the User to Des Hôtels & Des Îles is intended for Des Hôtels & Des Îles and its subcontractors established in or outside the European Union for the purposes of processing the User's request by the services of Des Hôtels & Des Îles and, unless the User objects by contacting Des Hôtels
& Des Îles to inform them of the products and services of the Des Hôtels & Des Îles group. In this respect, Des Hôtels & Des Îles may, in its capacity as a member of the Des Hôtels & Des Îles group, send the User information enabling him/her to become better acquainted with and make better use of its Site, to enable him/her to benefit from promotional offers broadcast on this Site and to propose offers from its Partners. Where applicable, offers from Des Hôtels & Des Îles 's Partners may only be sent to the User by SMS or e-mail subject to the User's prior consent, in accordance with the provisions of law 2004-575 of June 21, 2004 "for confidence in the digital economy", law 78-17 "informatique et libertés" amended by law 2004-801 of August 6, 2004, and in accordance with Des Hôtels & Des Îles 's Privacy Charter appearing on the Site.
In accordance with the French Data Protection Act (Loi Informatique et Libertés) of January 6, 1978, as amended, the User has the right to access, modify, rectify and delete data concerning him or her at any time. This right may be exercised by sending an e-mail via the "Contact" section of the Site, or by sending a letter to Des Hôtels & Des Îles : 120 Rue La Boétie - 75008 Paris, subject to proof of identity.
9.2 Claims service
All requests for information, clarification and any complaints must be sent to Des Hôtels & Des Îles, which collects them in the name and on behalf of the Partners, within 30 days of the end of the stay:

Complaints will only be accepted insofar as the difficulties to which they give rise have been reported to Des Hôtels & Des Îles or to the Partner during the trip, so that an attempt can be made to remedy them in order to limit the prejudice suffered by the User.
No claim will be accepted for loss(s), damage(s) or theft(s) of luggage, clothing or personal items placed under the User's surveillance during the stay, except in the event of proven fault on the part of Des Hôtels & Des Îles or its Partners. Luggage checked with an airline is only insured for the duration of the journey.
ARTICLE 10. RESPONSIBILITIES AND GUARANTEES CONCERNING USE OF THE SITE
No warranty is given to the User with respect to :
- the absence of anomalies, errors and bugs likely to affect navigation on the Site or the implementation of any functionality offered on the Site; or
- the possibility of correcting such anomalies, errors or bugs; or of
- the absence of any interruption or breakdown in the operation of the Site; or
- whether the Site is compatible with any particular hardware or configuration.
In no event will Des Hôtels & Des Îles be liable for any direct, indirect and/or consequential damages, whether foreseeable or unforeseeable (including loss of profits, loss of opportunity, etc.) arising out of the supply and/or use of, or the total or partial inability to use, the features of the Site.
Hypertext links on the Site referring the User to other Internet sites are intended solely to facilitate the User's research.
In any event, the User declares that he/she is aware of the characteristics and limits of the Internet, in particular its technical performance, response times for consulting, querying or transferring data, and the risks associated with the security of communications.
ARTICLE 11. INTELLECTUAL PROPERTY
11.1 General information
The Site, its content and all of its constituent elements are creations for which companies in the Des Hôtels & Des Îles group and/or, where applicable, Partners, are the holders of all intellectual property rights and/or operating rights, in particular copyright, database rights, trademark rights and design rights.
The Site, as well as the software, databases, texts, information, analyses, images, photographs, graphics, logos, sounds or any other data contained on the Site remain the exclusive property of companies in the Des Hôtels & Des Îles group and/or of Partners or, where applicable, of their respective owners with whom the latter have entered into usage agreements.
The User is granted a non-exclusive, non-transferable, private right to use the Site and the data contained therein. The right thus granted consists of (i) the right to consult online the data and information contained on the Site and (ii) a right of reproduction consisting of printing and/or saving the data and information consulted. This right of use is for strictly private purposes only.
Any other use of the Site, in particular commercial use, by the User is prohibited. In particular, the User undertakes not to reproduce and/or represent for any use other than private, sell, distribute, issue, translate, adapt, broadcast or communicate, in full or in part, in any form whatsoever, any element, information or data on the Site.
Furthermore, the User shall refrain from introducing, by any means whatsoever, data likely to modify or prejudice the content or presentation of the Site.
Any hypertext link to the Site, regardless of the type of link, must be authorized in advance by Expedia, acting in the name and on behalf of the holder of the right concerned, on paper or electronically.
11.2 Software
The use of any software downloaded from the Site to access certain Services or functionalities is governed by the terms of the accompanying license. The User undertakes not to install, copy or use such software without first agreeing to the terms of said license.
For any software not accompanied by a license, the User is granted a temporary, private, personal, non-transferable and non-exclusive right to use this software in order to be able, to the exclusion of any other use, to access the Services and functionalities which make the use of this software necessary. By installing or using the software, the User agrees to respect this condition.
ARTICLE 12. PROTECTION OF PERSONAL DATA
The information communicated by the User on the Site is used to process and execute his/her reservations.
As part of its commercial activity as a tourism service provider, Des Hôtels & Des Îles may process personal information about you or a third party.
A new General Data Protection Regulation n°2016/679 on the protection of individuals with regard to the processing of personal data and on the free movement of such data (known as "RGPD") came into force, on May 25, 2018. This Regulation significantly changes the Loi Informatique et Libertés n°78-17 of January 6, 1978 applicable, until then in France.
Des Hôtels & Des Îles concerned about the confidentiality of your personal data and those of your customers strengthen its policy on the protection of personal data in order to comply with the obligations by the Regulations in force and in particular, the obligations provided by the RGPD.
These "General Terms and Conditions of Use and Personal Data Protection" inform you of the manner in which we collect and process your personal data and that of your customers. Please read them carefully.
Important information:
We only use your personal data in the cases provided for by law:
- The performance of a contract entered into with you,
- Compliance with a legal obligation,
- Your consent to the use of your personal data, those of your employees and those of your customers,
- The existence of a legitimate interest in using your personal data. A legitimate interest is a set of commercial or business reasons that justifies the use of your personal data by Des Hôtels & Des Îles.
You have the right to access your personal data:
- The right to obtain information on the personal data we hold on you and/or your customers and the processing carried out;
- The right to modify or correct your personal data,
- The right to request the deletion of your personal data (right to be forgotten or erased), bearing in mind that legal or regulatory provisions may require us to retain such data.
- The right to ask us to restrict or object to the processing of your personal data, in certain circumstances.
- Your customers have the same rights, and can call on you to enforce them. All you have to do is pass on their requests to provide you with the information or take the necessary steps to ensure compliance.
Other requests for information requiring an optional response, or information relating to the User's interest in offers that may be sent to him, are intended to help us get to know him better and improve the services we offer.
Unless the User objects, Des Hôtels & Des Îles may communicate this optional information concerning the User to companies in its group, including outside the European Union. The User expressly consents to this transfer.
Des Hôtels & Des Îles may send the User, by any means (electronic, paper, sms, etc.), information enabling the User to better understand and use their respective sites, to enable the User to benefit from promotional offers published on these sites and to propose offers from their Partners, in strict compliance with the provisions of the French law "pour la confiance dans l'économie numérique" and the amended French law "informatique et libertés", subject to the User's prior consent or opposition, as specified in the Privacy Charter on the Site.
In addition, Des Hôtels & Des Îles transmits information relating to the User's reservation to its insurer. This transmission enables Des Hôtels & Des Îles to combat credit card fraud.
The occurrence of an unpaid invoice due to fraudulent use of a bank card will result in the registration of the details relating to the reservation of the User who is at the origin of this unpaid invoice in a payment incident file set up by the insurer and placed under its responsibility.
You can exercise this right by sending an e-mail from the "Contact" section of the Site, or by sending a letter to Des Hôtels & Des Îles - 120, Rue La Boétie - 75008 Paris - France, subject to proof of identity.
ARTICLE 13. APPLICABLE LAW
The contract between Des Hôtels & Des Îles and the User is expressly governed by French law.
Any dispute relating to its interpretation and/or performance shall be subject to the jurisdiction of the French courts.
