Rules for the " Advent calendar 2024" competition

ARTICLE 1 - Organizing company

The company LEADER HOTELS under the commercial label DES HOTELS ET DES ILES with a capital of 7622.45 euros registered with the RCS Paris B339 261 695 having its registered office at P/O CREOLE BEACH - BP 61 / 97190 Gosier - Guadeloupe (hereinafter the "Organizing Company"), is organizing from December 1 to December 24, 2024, a free instant win game with no obligation to purchase entitled "Advent Calendar 2024", on our Instagram and Facebook pages (hereinafter the "Site"), under the conditions defined hereinafter (hereinafter the "Game").

ARTICLE 2 - Participants

This Game is open to all individuals of legal age (as evidenced by their marital status) and capacity.

Any participation in this Game implies unreserved acceptance by the participants (hereinafter the "Participants") of these Rules (hereinafter the "Rules"), without any reservation or prior condition on the part of the candidate (failure to comply with the Rules will result in the pure and simple nullity of the candidate's participation and the awarding of any prizes).

Any entry to the Game that is incomplete, does not comply with the conditions set out in the Rules, contains false, falsified or erroneous information or is registered after the entry deadline (December 24, 2024) will not be taken into account and will be considered null and void.

Each participant may play only once per day (same name, same postal or e-mail address).

ARTICLE 3 - Terms of participation

From December 1, 2024 to December 24, 2024, 24 (twenty-four) prizes, as described in Article 4 below, may be won.

To play, Participants must:

- Click on "Try my luck"
- Click on the box of the day
- Complete the form and tick the box "I accept the rules of the competition"
- Scratch the 9 (nine) boxes
- Find out if they have won or lost (instant win)

ARTICLE 4 - Winning entries and prizes

4.1 Designation of the winner

The competition is based on an instant win mechanism.

The winning participant certifies that any personal details requested are true and accurate. He/she also agrees to submit to any verification of the veracity of the contact details communicated (telephone number, name, address, contact details, etc.), the definitive awarding of the prize being pronounced after said verifications.

The participant authorizes all verifications concerning his/her identity and domicile. To this end, the Organizing Company reserves the right to request any participant to provide a copy of the documents attesting to these elements. Any false or erroneous declaration, in particular concerning contact details, will automatically result in the cancellation of the prize.

In addition, the Organizing Body reserves the right to cancel the entries of anyone who is registered several times under different identities or who provides inaccurate or manifestly inconsistent and/or fanciful information, and generally in the event of fraud.

By accepting his/her prize, the winner expressly authorizes the Organizing Body, free of charge, to use his/her first and last names in all media, including commercial media, for information purposes, photo credit (unless expressly opposed) or promotional purposes, for any use related to the Game until December 31, 2024. Under the aforementioned conditions, this authorization does not entitle the winner to any rights or financial consideration other than the prize. It is hereby specified that the winner may withdraw his/her authorization under the conditions defined in article 5.

4.2 Endowments

It is hereby specified that there will be 25 (twenty-five) winners for this Game.

- Lot n°2 : 1 stay of 2 nights for 2 persons in accommodation and breakfast at La Toubana Hôtel & Spa

- Lot n°4 : 1 stay of 2 nights for 2 people in accommodation and breakfast at Langley Resort Fort Royal
- Lot n°5 : 1 night for 2 people in accommodation only at Jungle Bay, in Dominica -> valid until November 12, 2025, excluding the period of the 2025 Creole Music Festival.
- Lot n°6 : 1 stay of 2 nights for 2 persons in accommodation and breakfast at La Créole Beach Hôtel & Spa
- Lot n°7 : 1 stay of 3 nights for 2 persons in accommodation only at Mahogany Hôtel Residence & Spa

- Lot n°8 : 1 stay of 2 nights for 2 people on a half-board basis (breakfast and dinner excluding drinks), at the Anse Chastanet hotel in Saint Lucia -> valid from March 1, 2025 to March 1, 2026.
- Lot n°9: 1 stay of 2 nights for 2 people in accommodation and breakfast at the Langley Resort Fort Royal
- Lot n°10: 1 return ticket with the shipping company "Express des Iles" for Marie-Galante for 2 people
- Lot n°11: 1 stay of 3 nights for 2 people in accommodation only at the Mahogany Hôtel Résidence & Spa

- Lot n°20 : 1 return ticket with the shipping company "Express des Iles" for Dominica for 2 people
- Lot n°21 : 1 stay of 3 nights for 2 people in accommodation and breakfast at La Créole Beach Hôtel & Spa
- Lot n°22 : 1 stay of 3 nights for 2 people in accommodation and breakfast at Secret Bay, in Dominica -> valid from April 21, 2025 to October 31, 2025, "adults only"
- Lot n°23 : 1 stay of 3 nights for 2 people in accommodation and breakfast at Jardin Malanga
- Lot n°24 : 1 stay of 6 nights in accommodation and breakfast at La Créole Beach Hôtel & Spa + return Corsair flights in Economy class for 2 people.

Given that the average value of the operation is €21160 including tax, it is hereby specified that :

- There will be only one winner per instant (per day)
- The prize will not give rise to monetary equivalence or exchange for any reason whatsoever,
- The prize issued will be non-transferable, non-exchangeable and non-refundable,
- Prizes valid for 1 year, not usable during festive periods and winter school vacations. Some hotels apply a different policy regarding validity dates (see specific conditions in the prize statement above).
- Subject to availability,
- Any prize not used during its validity period will be definitively lost,
- In the event of force majeure or any other circumstance beyond the control of the Organizing Company, the latter reserves the right to replace the planned prize with another of equivalent nature and value to the previous one.

4.3 Terms of delivery

The Game winner will be notified of the result by private message sent from the Instagram or Facebook messaging service, within four (4) days of the draw. The winner's name will be published on the Organizing Body's social networks.

The Organizing Body may not be held liable for sending an e-mail to an incorrect address due to an error on the part of the participant, nor for the malfunction of the e-mail sending system. Nor can the Organizing Body be held liable for any change in the winner's e-mail address.

If the winner does not contact the Organizing Body in writing (e-mail, letter, etc.) within seven (7) days of the date on which he/she was first notified, the prize will be definitively forfeited.

Once the winner has accepted the prize, he/she will receive an e-mail confirming his/her win, with details of how to reserve/hand over the prize.

ARTICLE 5 - Personal data

In the context of the Game, the Organizing Body may collect participants' personal data.

In accordance with the provisions of article 34 of law no. 78-17 known as the "Loi Informatique et Libertés", all participants are informed that the personal information collected is necessary for their participation in this Game and is subject to computer processing. In this respect, the Organizing Company guarantees that the personal data collected will be processed in compliance with the applicable legislation, including the French Data Protection Act (Loi Informatique et Libertés) and European Regulation 2016/679 of April 27, 2016 on the protection of personal data (hereinafter the "RGPD").

The data collected may be communicated to service providers and subcontractors that the Organizing Body may call upon for the purposes of organizing and/or managing the Game. In this respect, the Organizing Body guarantees that the data collected by these service providers and subcontractors will be processed in compliance with the RGPD.

The participant is informed that he/she has the right to access, rectify, oppose or delete his/her personal data. These rights may be exercised by writing to Des Hôtels & Des Îles at the following address:

Participants who exercise their right to delete their personal data before the end of the Game will be deemed to have waived their right to participate.

Depending on the choices made by participants at the time of data collection, the data may also be used to inform participants of Des Hôtels & Des Îles news and commercial offers, it being specified here that winners may withdraw their authorization at any time by sending a letter to the Marketing Department whose contact details are given above.

ARTICLE 6 - Liability

The Organizing Body may cancel or suspend all or part of the Game if it appears that fraud has occurred in any form whatsoever in connection with participation in the Game. In the event of misconduct or fraud on the part of a participant, the Organizing Body reserves the right to automatically disqualify any participation by the latter and/or the right not to award the prize to the fraudsters and/or to prosecute the perpetrators of such fraud before the competent courts, without the latter being able to claim anything whatsoever.

However, the Organizing Body may not be held liable in any way whatsoever to participants if it is forced to shorten, extend or cancel the present Contest, or to modify its conditions for any reason whatsoever. In particular, it will be considered fraudulent for a participant to register and then take part in the Game under one or more fictitious names or names borrowed from one or more third parties. Each participant must register and take part in the Game under his or her own and unique name.

The connection of any person to the Internet sites from which participation is made and participation in the Game is under the sole responsibility of the participants. It is the responsibility of each participant to take all appropriate measures to protect their own data and/or software stored on the computer used to take part in the Game against any attack.

The Organizing Body and its subcontractors decline all responsibility for any incidents that may occur during the enjoyment of the prize and/or due to its use and/or its consequences.

ARTICLE 7 - Acceptance and availability of the Rules

Participation in the Game implies full acceptance of the Rules, available on the https://deshotelsetdesiles.com website.

To be taken into account, any disputes relating to the Rules must be made in writing and addressed to the Marketing Department of the Organizing Body, whose contact details are given in Article 5, no later than thirty (30) days after the closing date for participation in the Game as indicated in Article 3 of the Rules.

The complete Rules will be sent free of charge to anyone who requests them in writing to Des Hôtels & Des Îles 120 Rue La Boétie 75008 Paris.

ARTICLE 8 - Modification of the Rules

The Organizing Body reserves the right to modify the Rules. In this case, the modifications made will be inserted in the Rules. These modifications will form an integral part of the Rules and will be considered as annexes thereto.

ARTICLE 9 - Applicable law - Jurisdiction

The Regulations are governed by French law.

Any difficulty relating to the application, interpretation or consequences of the Regulations will be settled by the competent court.
